Distance Sale Policy – Your Right to Cancel

Fox & Faolan Motors is committed to operating in full compliance with UK consumer protection law. When purchasing a vehicle without visiting our premises in person before the sale is completed (for example, through our website, over the phone, or via electronic communication), your purchase is classed as a distance sale.
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you are entitled to a statutory right to cancel this agreement. The following terms outline your rights and responsibilities under our Distance Sale Policy.
Your Right to Cancel

You may cancel this contract within 14 days without giving any reason.

The 14-day cancellation period will expire 14 days after you, or a nominated third party acting on your behalf, take physical possession of the vehicle.
How to Cancel
To exercise your right to cancel, you must provide us with a clear and unambiguous written statement of your decision. This can be sent by post or email. You are not obliged to use a specific cancellation form, but the communication must clearly state your intention to cancel.

Your cancellation will be valid as long as it is sent before the 14-day cancellation period has expired.
Effects of Cancellation
If you cancel this contract:

We will reimburse all payments received from you, including the purchase price of the vehicle.

We will not reimburse any delivery costs that exceed our standard delivery option (e.g. if you paid for enhanced or express delivery).

Deductions will be made if the vehicle has suffered any reduction in value due to handling or use that goes beyond what is necessary to assess its condition and functionality. This includes, but is not limited to:

Mileage exceeding 20 miles, charged at £1 per mile.

Cosmetic or mechanical damage, excessive wear, or evidence of misuse.

Any repairs or remedial work required to return the vehicle to the condition in which it was supplied.

Refunds will be made:
-
Within 14 days of the date we receive the returned vehicle, together with all associated documents (V5C logbook, service history, manuals, spare keys, and any accessories supplied).

Using the same payment method as your original transaction, unless another method is expressly agreed in writing.

Without charging any fees for reimbursement.
Part Exchange Vehicles:

If your purchase involved a part exchange, we will return the part exchange vehicle to you if it remains in our possession.

If the part exchange vehicle has already been sold or disposed of, we will deduct the agreed value from the refund.

If your agreement included negative equity, you remain fully responsible for this amount as per the terms of your finance or purchase contract.
Please note: Refunds will not be processed until the vehicle and all related documentation have been received and inspected.
Your Responsibilities
When exercising your right to cancel, you must comply with the following obligations:

Return of the Vehicle:

You must return the vehicle to us at your own expense and without undue delay, and in any case within 14 days of notifying us of your decision to cancel.

The vehicle must be returned to our business premises in a safe and roadworthy condition.

Responsibility Until Return:

You remain fully responsible for the vehicle until it has been received and formally accepted by Fox & Faolan Motors.

This responsibility includes ensuring that:

The vehicle is covered by comprehensive insurance.

The vehicle remains taxed and legally permitted for road use until returned.

You are liable for any penalties, fines, or charges incurred during the period of possession (e.g. speeding fines, parking charges, congestion charges).

Condition of the Vehicle:

You must take reasonable care of the vehicle and avoid using it beyond what is necessary to assess its suitability.

Any use that results in loss of value — including excessive mileage, avoidable wear and tear, damage, or neglect — will result in deductions from your refund.

The vehicle should only be driven for a brief demonstration of functionality, equivalent to a short test drive. Extended use beyond this will not be accepted as reasonable.

Documentation and Accessories:

You must return all items supplied with the vehicle, including but not limited to:

The V5C registration certificate (logbook).
-
Service history and maintenance records.
-
User manuals and handbooks.
-
All sets of keys.
-
Any accessories, tools, or additional equipment provided at the time of sale.

Failure to return these items may delay reimbursement or result in deductions to cover replacement costs.
Confirmation of Agreement
By completing a distance sale with Fox & Faolan Motors, you acknowledge that you have read, understood, and accepted the terms of this Distance Sale Policy.
Your 14-day right to cancel is designed to give you peace of mind when purchasing remotely. However, it is also your responsibility to ensure the vehicle is looked after, returned promptly, and supplied back to us in the condition in which it was received.
